Grant of Right to Use Photographic Likeness

I understand that Ultimate Dance Center, LLC utilizes a mobile online viewing application that allows friends and family of dancers to view classes on their mobile devices. This service provides an opportunity to monitor a dancer’s progress, observe participation, ensure safety, and stay informed about their activities.

In connection with this service, I acknowledge that video recordings, photographs, or other photographic likenesses of myself/the dancer may be taken by Ultimate Dance Center, LLC. By signing the release below, I give consent to the use of these likenesses for the purposes of the mobile online viewing application and/or promotional materials used by the studio.

Release

I, the dancer—or the parent/legal guardian if the dancer is under the age of 18—grant Ultimate Dance Center, LLC, a Florida limited liability company located at 2980 Lakeland Highlands Road, Lakeland, FL 33803 (“Grantee”), its successors, and assigns, the right to use and publish video recordings, photographs, or other likenesses of me/the dancer for advertising purposes and/or within its mobile viewing application.

I waive any right to compensation or to claim ownership of such media or any income generated by their use. I understand that these images may be used in whole or in part, in composite or altered form, in conjunction with my name or a fictitious name, and in any format or medium, whether in color or otherwise.

I acknowledge that all media will be captured during class time, within the studio, or at an affiliated Ultimate Dance Center, LLC event.

I further waive the right to inspect or approve the final product or any accompanying material or usage.

I release and discharge the photographer, videographer, Grantee, and all affiliated owners, agents, employees, successors, and authorized representatives from any claims arising from blurring, distortion, alteration, or use in composite form—unless proven to have been created with malicious intent.

Release and Waiver of Liability and Indemnity

I understand that participation in dance carries inherent physical risks, including but not limited to: jumping, spinning, stretching, partner work, tumbling, pointe work, aerobic movement, and other strenuous activities that may result in injury to bones, ligaments, tendons, and other soft tissues.

Due to these risks, I acknowledge that if a dancer arrives more than 10 minutes late to class, they may be asked to sit out and observe rather than participate.

By signing this Release and Waiver of Liability and Indemnity Agreement, I voluntarily accept all risks of bodily or personal injury that may arise from participation in Ultimate Dance Center, LLC activities.

I release and hold harmless Ultimate Dance Center, LLC, its owners, agents, and employees from any liability for injury, or for damage or loss of personal property, resulting from participation in any affiliated activity. I also waive my right to file a claim against any Ultimate Dance Center, LLC insurance policy for such incidents.

Furthermore, I agree to indemnify and defend Ultimate Dance Center, LLC, its owners, agents, and employees from any claim or cause of action arising from my/the dancer’s participation in studio activities.
